Before paying a deposit

Check the certificate, co-holders, mortgage, boundaries, planning and the parties’ eligibility. A map or estimate does not establish legal title. Do not use a nominee to bypass ownership restrictions.

Under Article 328, a defaulting depositor loses the deposit; a defaulting recipient refunds it plus an equivalent amount, unless agreed otherwise. Disputed fault, validity and exceptions require legal review.
